Terms & Conditions - Parenting Companion App
A joint venture between ConnectFirst(TM) and Bridge to Understanding

Parties
These Terms and Conditions apply to the use of the ConnectFirst(TM) Parenting Companion App ("the App"), which is operated as a joint venture between ConnectFirst(TM) and Bridge to Understanding.

For the purposes of these Terms:

"ConnectFirst(TM)" and "Bridge to Understanding" are collectively referred to as "we", "us", or "our"
All rights, protections, limitations of liability, disclaimers, and indemnities in these Terms apply equally and jointly to ConnectFirst(TM) and Bridge to Understanding, including their respective directors, shareholders, officers, employees, contractors, agents, affiliates, successors, and assigns

Joint Venture Limitation
You acknowledge and agree that:

ConnectFirst(TM) and Bridge to Understanding operate as independent entities within this joint venture
Nothing in these Terms creates a legal partnership, agency, employment, or fiduciary relationship beyond the operation of the App
Neither ConnectFirst(TM) nor Bridge to Understanding is liable for the acts, omissions, or conduct of the other except to the extent required by law
To the fullest extent permitted by law:

Any liability arising under these Terms is limited in accordance with the liability provisions set out in Section 6
Each entity's responsibility is limited to its own involvement in the operation of the App

1. Acceptance of Terms
By accessing or using the ConnectFirst(TM) Parenting Companion App ("the App"), you agree to be bound by these Terms and Conditions.

Access to and use of the App is strictly conditional upon acceptance of these Terms and Conditions. If you do not accept these Terms, you are not authorised to use the App and must not access or use it. Continued use of the App constitutes acceptance of these Terms.

2. Purpose of the App
The App is designed to provide general parenting support, guidance, educational resources, and informational content to assist users in understanding and responding to common parenting situations.

The App may offer suggestions, strategies, recommendations, prompts, and insights based on user input. These are intended for general guidance only and are not tailored to individual circumstances, diagnoses, risks, or specific needs.

The App is not a substitute for professional advice, assessment, diagnosis, or treatment, including but not limited to medical, psychological, therapeutic, behavioural, safeguarding, crisis, or legal advice.

The App does not provide clinical services, crisis intervention, emergency response, personalised therapeutic intervention, professional supervision, or specialist assessment.

The App does not establish any professional-client, therapist-client, practitioner-client, advisory, fiduciary, or other special relationship between the user and ConnectFirst(TM) or Bridge to Understanding.

The information provided through the App may not be suitable, safe, accurate, complete, reliable, or appropriate for all children, families, users, or situations.

No Duty of Care:
To the fullest extent permitted by law, use of the App does not create any duty of care on the part of ConnectFirst(TM) or Bridge to Understanding toward any user, child, family member, dependent, or third party. You acknowledge that you are solely responsible for all decisions made and all actions taken or not taken based on the App's content.

You must not rely on the App as your sole or primary source of guidance. You are responsible for seeking appropriate advice from qualified professionals for any concerns relating to a child's development, behaviour, safety, health, wellbeing, trauma, risk, crisis, abuse, neglect, or legal circumstances.

This section must be read together with Section 6 (Limitation of Liability and Disclaimer).

3. Use of Artificial Intelligence
The App uses artificial intelligence (AI) to generate responses, suggestions, prompts, recommendations, and other content.

You acknowledge and agree that:

AI-generated content may not always be accurate, complete, reliable, current, suitable, safe, or appropriate for your circumstances
The App may make mistakes, provide incomplete or outdated information, fail to detect important context, or misinterpret user input
The App may generate content that is inappropriate, ineffective, unsuitable, unsafe, or incorrect
All content is generated automatically and should be independently reviewed before being relied upon or acted upon

4. No Professional Advice
All information, suggestions, prompts, strategies, recommendations, and other content provided through the App are for general informational and educational purposes only.

The App does not provide professional advice, diagnosis, treatment, safeguarding advice, crisis advice, legal advice, therapeutic services, behavioural support services, medical services, or emergency intervention.

Nothing in the App should be taken as medical, psychological, therapeutic, behavioural, safeguarding, crisis, or legal advice.

You must seek advice from an appropriately qualified professional regarding any concern involving a child, family, behaviour, health, safety, risk, crisis, abuse, neglect, trauma, mental health, or legal issue.

5. User Responsibility
By using the App, you agree that:

You are solely responsible for how you interpret, apply, and use any information, suggestions, prompts, strategies, recommendations, or guidance provided by the App
You will exercise your own independent judgement before acting on any content generated by the App
You will not rely on the App as your sole source of guidance in any situation
You will not use the App for urgent, critical, high-risk, crisis, or emergency decision-making
You are solely responsible for ensuring the safety, supervision, welfare, and wellbeing of any child or person in your care at all times
Parenting decisions, supervision decisions, safety decisions, behavioural responses, and all related outcomes remain entirely your responsibility
You are responsible for determining whether any suggestion, recommendation, or strategy is appropriate for your own circumstances before implementing it
You are responsible for seeking qualified professional, medical, legal, therapeutic, behavioural, safeguarding, crisis, or emergency advice where required
You agree not to use the App in a way that could cause harm to yourself, a child, or any other person
You agree not to misuse, misinterpret, selectively apply, or rely on App content in unsafe, inappropriate, negligent, unlawful, or unintended ways
You acknowledge that the App cannot account for all variables, all family circumstances, all risks, all diagnoses, all histories, all trauma backgrounds, or all individual differences
You accept full responsibility for any outcomes resulting from your use of the App, including any action or inaction taken after reading or receiving App content
You are responsible for maintaining the confidentiality of your account and login details
You are responsible for all activity that occurs under your account

6. Limitation of Liability and Disclaimer
To the fullest extent permitted by law, ConnectFirst(TM) and Bridge to Understanding:

Do not guarantee that the App, its content, or any suggestions, prompts, strategies, or recommendations will be effective, suitable, successful, safe, or appropriate for your individual circumstances
Do not accept responsibility or liability if any advice, information, strategies, prompts, recommendations, or guidance provided by the App do not work, are ineffective, are unsuccessful, are inappropriate, are unsuitable, or lead to unintended outcomes
Do not accept responsibility or liability if the App tells a user to do something, suggests a course of action, recommends a strategy, or provides guidance that is later alleged to be inappropriate, ineffective, incorrect, unsuitable, harmful, incomplete, or not to have worked
Accept no liability whatsoever for any loss, damage, injury, harm, cost, expense, claim, or consequence arising from or connected with use of the App, including but not limited to:
personal injury
illness
psychological harm
emotional harm
financial loss
property damage
harm to a child
harm to another person
abuse
neglect
misuse of information
misinterpretation of information
inappropriate reliance on the App
failure to seek professional support
delay in seeking support
indirect, incidental, special, exemplary, punitive, or consequential loss or damage
death
This exclusion of liability applies regardless of the cause, including negligence, system failure, omission, delay, error, technical malfunction, security incident, failure of the App to warn, failure of the App to identify risk, or reliance on AI-generated content.

AI-Generated Advice Disclaimer
You acknowledge and agree that any suggestions, recommendations, prompts, responses, guidance, or instructions provided by the App are automatically generated by artificial intelligence and are provided for general informational purposes only.

ConnectFirst(TM) and Bridge to Understanding:

Do not accept any responsibility or liability for the content of AI-generated responses
Do not accept responsibility for any actions taken based on suggestions, recommendations, prompts, guidance, or instructions provided by the App
Do not accept liability where the App's content is inappropriate, unsuitable, ineffective, incomplete, inaccurate, unsafe, or does not work as expected
Are not responsible for any interpretation, decision, omission, or action taken by a user in reliance on the App
This applies even where the App appears to provide specific advice, recommendations, prompts, or instructions.

Use at Your Own Risk
You acknowledge that you use and rely on any information provided by the App entirely at your own risk.

You expressly agree that ConnectFirst(TM) and Bridge to Understanding will not be held liable for any outcomes arising from following or not following any suggestion, recommendation, or instruction generated by the App.

Additional Liability Exclusions
To the fullest extent permitted by law, ConnectFirst(TM) and Bridge to Understanding are not liable under any circumstances for:

any decision made or not made by a user based on the App
any failure by the App to provide appropriate, timely, or accurate information
any reliance placed on incomplete, incorrect, or misleading content
any delay in seeking professional, medical, legal, or emergency support
any escalation of a situation due to reliance on the App
any failure to achieve a desired parenting, behavioural, developmental, or safety outcome
You acknowledge that:

The App cannot and does not replace human judgement
The App cannot anticipate or prevent harm
The App cannot guarantee safe or appropriate outcomes in any circumstance
To the fullest extent permitted by law, all liability of ConnectFirst(TM) and Bridge to Understanding is expressly excluded.

7. High-Risk Situations and Safety Disclaimer
You acknowledge and agree that:

The App is not designed to assess, prevent, predict, monitor, detect, or respond to risk of harm, abuse, neglect, self-harm, suicide risk, violence, behavioural crisis, emergency, or crisis situations
The App must not be relied upon in situations involving safety risks, safeguarding concerns, behavioural crises, suspected abuse, suspected neglect, mental health crises, or emergencies
You are solely responsible for seeking immediate professional, crisis, safeguarding, emergency, police, medical, child protection, or other appropriate support wherever there is any risk to a child or another person

Crisis and Emergency Responsibility
In any situation involving crisis, risk of harm, threat, abuse, neglect, urgent concern, or emergency, you must immediately contact appropriate emergency services, crisis services, medical services, police, child protection authorities, or other relevant supports.

The App may include prompts or recommendations to seek external support; however, you must not rely on the App to identify, detect, recognise, recommend, or respond to crisis situations.

ConnectFirst(TM) and Bridge to Understanding:

Accept no responsibility or liability for any failure of the App to identify, detect, or respond to a crisis situation
Are not responsible if the App does not recommend or prompt you to contact emergency services, a crisis hotline, police, child protection, or any other support service
Are not liable for any outcomes resulting from a failure to seek appropriate external support, whether or not the App provided any prompt, warning, recommendation, or direction
You expressly agree that ConnectFirst(TM) and Bridge to Understanding will not be held liable for any harm, injury, or death arising from a failure to seek emergency or crisis support, regardless of whether the App provided or failed to provide such direction.

No Crisis Detection Guarantee
You acknowledge and agree that:

The App does not monitor, track, or analyse user behaviour in real time for safety risks
The App may fail to recognise indicators of harm, abuse, neglect, or crisis
The App may not respond appropriately or at all in high-risk situations
You agree that:

You must not rely on the App for crisis identification or response under any circumstances

8. No Guarantees
We make no guarantees, warranties, representations, or assurances that:

The App will be uninterrupted, available, accessible, secure, or error-free
The App will be accurate, reliable, complete, current, suitable, or fit for purpose
The content will meet your individual needs, expectations, preferences, or desired outcomes
Any suggested strategies, prompts, or recommendations will produce any particular result or outcome
The App will identify risks, detect crises, or provide suitable responses in any circumstance
The App is provided on an "as is" and "as available" basis without warranties of any kind.

We do not guarantee any behavioural, developmental, therapeutic, or parenting outcomes.

9. Subscription and Payment Terms
Access to the App is provided on a subscription basis and may be billed monthly or yearly, depending on the option selected by the user.

By subscribing, you agree to pay all fees and charges associated with your selected plan.

Payments are payable in advance and are non-transferable.

If a payment is declined, dishonoured, reversed, charged back, missed, or otherwise not successfully received, access to the App may be revoked immediately without notice.

ConnectFirst(TM) and Bridge to Understanding reserve the right to suspend, restrict, or terminate access to the App until all outstanding amounts are paid in full.

10. Refund Policy
We offer a 30-day money-back guarantee, subject to the following conditions:

Refunds are only available where there is a verified technical fault that prevents access to or basic use of the App
Refund requests must be made within 30 days of initial purchase
Refunds will not be provided where:

You change your mind
You decide you do not want the App
The App is not what you expected
The App does not meet your personal preferences or expectations
You are dissatisfied with the outcomes or results
You simply choose not to use the App
All refund decisions are made at the sole discretion of ConnectFirst(TM) and Bridge to Understanding, subject to applicable law.

11. Safety and Emergency Situations
The App is not intended for emergency use.

If you have concerns about the safety, health, wellbeing, abuse risk, crisis risk, or immediate welfare of a child or any other person, you must contact emergency services or an appropriately qualified professional immediately.

12. Privacy and Data Use
By using the App, you acknowledge and agree that ConnectFirst(TM) and Bridge to Understanding may collect, receive, store, use, and process information including, but not limited to:

your name
your email address
your phone number or other contact details
payment details
billing information
account details
all information, text, responses, prompts, questions, and other material you input into the App
records of your interactions with the App
technical and usage data associated with your use of the App
This information may be stored on a secure website, secure systems, or secure third-party platforms used to operate the App.

While we take reasonable steps to store information securely, we do not guarantee the privacy, confidentiality, or security of any information transmitted to, stored in, or processed through the App or any related system.

To the fullest extent permitted by law, ConnectFirst(TM) and Bridge to Understanding are not liable for any major or minor breach of privacy, confidentiality, or security, including but not limited to:

data breaches
cyber incidents
hacking
unauthorised access
disclosure of stored information
loss of data
interception of data
security failures of third-party systems or providers
You acknowledge that you provide, enter, and store information in the App at your own risk.

Third-Party Storage and Processing
You acknowledge that:

Your data may be processed, stored, or transmitted via third-party systems, platforms, and infrastructure
These systems may be located in different jurisdictions
ConnectFirst(TM) and Bridge to Understanding:

Do not control all aspects of third-party systems
Are not liable for any breach, failure, or loss arising from third-party providers

13. Changes to Terms
ConnectFirst(TM) and Bridge to Understanding may amend, update, replace, or modify these Terms and Conditions at any time.

Continued use of the App after any change constitutes acceptance of the updated Terms and Conditions.

14. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws applicable in the jurisdiction in which the user accesses or uses the App.

To the extent permitted by law, you agree that:

Any disputes arising from or in connection with these Terms or the App will be subject to the applicable laws of that jurisdiction
Where multiple jurisdictions may apply, these Terms will be interpreted in a manner that provides the maximum legal protection to ConnectFirst(TM) and Bridge to Understanding to the fullest extent permitted by law
To the fullest extent permitted by law, you agree to attempt to resolve any dispute informally prior to commencing legal proceedings.

16. Indemnity
You agree to indemnify, defend, and hold harmless ConnectFirst(TM) and Bridge to Understanding, including their officers, directors, employees, agents, contractors, affiliates, successors, and assigns, from and against any and all claims, actions, liabilities, losses, damages, costs, expenses, and legal fees arising out of or in connection with:

your use or misuse of the App
your reliance on the App or its content
any actions or omissions you take based on the App
any breach of these Terms and Conditions
any harm, loss, injury, abuse, neglect, damage, or death alleged to arise in connection with your use of the App
any claim brought by a third party arising from your use of the App or any content you input into it
This indemnity applies to the fullest extent permitted by law. This indemnity continues after termination of your access to the App and applies regardless of whether a claim is based on contract, negligence, statute, or any other legal basis.

17. Termination of Access
ConnectFirst(TM) and Bridge to Understanding reserve the right, in their sole discretion, to suspend, restrict, disable, refuse, or terminate your access to the App at any time, with or without notice.

This includes, but is not limited to, termination for:

failure to make payment
suspected misuse of the App
unlawful use
harmful use
breach of these Terms and Conditions
conduct that may expose any person to risk
any other reason considered appropriate by ConnectFirst(TM) or Bridge to Understanding
ConnectFirst(TM) and Bridge to Understanding are not liable for any loss, inconvenience, loss of access, loss of content, or other consequence arising from suspension or termination.

18. Prohibited Use
You agree that you will not:

use the App in any unlawful, abusive, harmful, negligent, reckless, fraudulent, or misleading way
use the App in a way that may harm yourself, a child, or any other person
use the App as a substitute for professional advice or emergency support
misuse, distort, manipulate, or misinterpret App content
input false, misleading, inappropriate, unlawful, or harmful information into the App
interfere with, disrupt, exploit, test, reverse engineer, copy, or attempt to compromise the App or its systems
Any prohibited or inappropriate use of the App is entirely your responsibility.

19. Service Availability and Discontinuation
ConnectFirst(TM) and Bridge to Understanding reserve the right, at any time and in their sole discretion, to modify, suspend, restrict, interrupt, remove, discontinue, or permanently shut down the App, in whole or in part, with or without notice.

This includes the right to:

stop the App at any time
remove features or functionality
change content or service offerings
suspend access temporarily or permanently
permanently cease operation of the App
ConnectFirst(TM) and Bridge to Understanding do not guarantee continuous, uninterrupted, or error-free availability of the App.

ConnectFirst(TM) and Bridge to Understanding are not liable for any loss of access, loss of data, loss of functionality, inconvenience, loss, or damage resulting from interruption, suspension, modification, or discontinuation of the App.

You acknowledge that the App may be discontinued permanently without compensation, refund, or continued access to data.

20. No Reliance
You acknowledge and agree that you must not rely on the App or any content generated by it as a substitute for independent judgement, supervision, professional advice, emergency advice, or risk assessment.

Any reliance on the App is entirely at your own risk.

ConnectFirst(TM) and Bridge to Understanding accept no responsibility or liability arising from any reliance on the App or its content.

21. Limitation of Liability Cap
To the fullest extent permitted by law, if any liability is found to arise despite the exclusions in these Terms and Conditions, the total liability of ConnectFirst(TM) and Bridge to Understanding is limited to the lesser of:

the total amount paid by you for the App in the 12 months before the claim arose, or
AUD $100
This limitation applies regardless of the form of action, whether in contract, tort (including negligence), statute, or otherwise.

22. Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable, that provision is severed and the remaining provisions continue in full force and effect.

23. Entire Agreement
These Terms and Conditions constitute the entire agreement between you and ConnectFirst(TM) and Bridge to Understanding in relation to the App and supersede all prior communications, understandings, discussions, and agreements relating to the App.

24. Waiver
Any failure or delay by ConnectFirst(TM) or Bridge to Understanding to enforce any right or provision under these Terms and Conditions does not constitute a waiver of that right or provision and does not prevent future enforcement.

25. Third-Party Services
The App may rely on or integrate with third-party services, providers, processors, payment systems, hosting services, AI systems, storage providers, or infrastructure.

ConnectFirst(TM) and Bridge to Understanding are not responsible or liable for the availability, performance, security, privacy, accuracy, failure, acts, omissions, or breaches of any third-party service or provider.

26. Force Majeure
ConnectFirst(TM) and Bridge to Understanding are not liable for any failure, delay, interruption, breach, or inability to perform arising from events beyond reasonable control, including but not limited to:

natural disasters
acts of God
war
armed conflict
terrorism
civil unrest
cyber incidents or attacks
internet or telecommunications outages
platform or system failures
third-party service failures
power outages
government actions or restrictions
labour disputes
pandemics or public health emergencies
or any other unforeseen or uncontrollable events

27. Acknowledgement
By accessing or using the App, you acknowledge and agree that:

you have read and understood these Terms and Conditions
you understand that the App uses artificial intelligence and may make mistakes
you understand that the App is not professional advice
you accept all risks associated with using the App
you use the App entirely at your own risk
you are solely responsible for any decisions, actions, or omissions arising from your use of the App

28. Eligibility
By accessing or using the App, you confirm and warrant that:

You are at least 18 years of age
You have the full legal capacity, authority, and competence to enter into these Terms and Conditions
You are legally permitted to use the App in your jurisdiction
You are authorised to make decisions for, and provide information about, any child or person in relation to whom you use the App
You have obtained any necessary consents required to input information about another person into the App
All information you provide to the App is accurate, complete, and not misleading
You will update your information where required to ensure it remains accurate
We reserve the right to suspend or terminate access where we reasonably believe these requirements are not met.

29. Safety-Based Suspension
ConnectFirst(TM) and Bridge to Understanding reserve the right, at their sole discretion, to immediately suspend, restrict, or terminate access to the App where:

there is any actual or suspected risk to a child or other person
there is suspected misuse, unsafe use, or inappropriate reliance on the App
there is behaviour that may result in harm, neglect, or unsafe outcomes
there is a breach of these Terms and Conditions
continued use may expose any person to risk
You acknowledge and agree that:

such action may be taken without notice
we are not liable for any consequences resulting from suspension or termination
we are not obligated to investigate, verify, or resolve any concerns prior to taking action

30. Intellectual Property
All content, materials, systems, features, functionality, algorithms, designs, text, graphics, and underlying technology within the App are owned by or licensed to ConnectFirst(TM) and Bridge to Understanding.

You must not, without prior written consent:

copy, reproduce, distribute, publish, or commercially exploit any part of the App
modify, adapt, translate, or create derivative works from the App
reverse engineer, decompile, or attempt to extract source code or underlying systems
use the App or its content for commercial, competitive, or resale purposes
You acknowledge that:

no ownership rights are transferred to you
your use of the App is limited to a personal, non-transferable, revocable licence

31. No Monitoring or Obligation to Intervene
You acknowledge and agree that:

ConnectFirst(TM) and Bridge to Understanding do not monitor user activity, inputs, or behaviour in real time
we do not actively review, assess, or respond to user content or interactions
To the fullest extent permitted by law:

we have no obligation to monitor, detect, or identify risk, harm, abuse, or crisis situations
we have no obligation to intervene, notify authorities, or provide assistance
we are not responsible for any failure to act, intervene, or respond to any situation

32. Data Loss
To the fullest extent permitted by law, ConnectFirst(TM) and Bridge to Understanding are not responsible or liable for:

loss of user data
corruption of data
failure to store, retrieve, or transmit data
deletion of data (whether intentional or accidental)
system errors resulting in loss of information
You acknowledge that:

data may be lost, corrupted, or inaccessible at any time
you are solely responsible for maintaining any records you wish to retain

33. Updates and Changes to the App
ConnectFirst(TM) and Bridge to Understanding reserve the right, at any time and without notice, to:

modify, update, or remove features, functionality, or content
change how the App operates or delivers information
introduce new limitations, restrictions, or requirements
discontinue any aspect of the App
You acknowledge and agree that:

the App may change at any time
such changes may affect functionality, usability, or outcomes
we are not liable for any impact of these changes, including loss of functionality or access

34. Not a Safety or Risk Management Tool
You acknowledge and agree that the App:

is not a safety system
is not a monitoring tool
is not a risk assessment tool
is not a safeguarding or child protection system
is not designed to prevent, detect, or respond to harm
The App must not be used to:

assess or manage risk
monitor behaviour for safety purposes
prevent harm, abuse, or neglect
replace supervision, judgement, or professional oversight
You accept that:

responsibility for safety remains entirely with you
the App cannot ensure safe or appropriate outcomes in any situation

35. Assumption of Risk
You acknowledge and agree that:

Use of the App involves inherent risks, including the risk that information may be incorrect, incomplete, or inappropriate
You voluntarily assume all risks associated with use of the App
You expressly agree that:

You are solely responsible for evaluating and acting upon any information provided
You accept full responsibility for any consequences arising from your use of the App
This assumption of risk applies even where harm, loss, injury, or damage is foreseeable.

36. No Class Actions
To the fullest extent permitted by law, you agree that any claim, dispute, or proceeding arising out of or in connection with the App or these Terms and Conditions must be brought in your individual capacity only.

You agree not to:

bring or participate in any class action, representative action, or collective proceeding
join or consolidate claims with those of any other user or third party

37. Account Access
You are responsible for all use of the App on your account or device, whether authorised by you or not.

You acknowledge and agree that:

any activity conducted through your account or device is deemed to be your responsibility
you are responsible for maintaining the confidentiality and security of your account credentials
ConnectFirst(TM) and Bridge to Understanding are not liable for any loss, damage, or consequences arising from unauthorised or shared use of your account or device
